It is potential bidders responsibility to satisfy themselves with condition of items prior to bidding by personally inspecting items they wish to place bids.

• Vehicles and titled items are sold in New York with an Affirmation of Repossession, Bill of Sale and Lien Release.

• This is standard procedure for New York State, but not an accepted procedure by all states.

• All other items are sold with Bill of sale from auction company and lien release from creditor

• If you are purchasing from another state, check with your local Department of Motor Vehicles or Notary to learn about the procedure for your state.

• Pre-bidding approval is necessary to participate in secured creditor auctions and is subject to approval by auction company and secured creditor.

Terms & Conditions of Auction

 

All property is sold 'As-Is', 'Where-Is', without warrantee implied or expressed.

 

Property is open to thorough public inspection, and it is the bidder's responsibility to determine condition prior to bidding

 

All items are sold with reserve and subject to the approval of the seller (secured creditor). If the reserve requirement is not met, we will contact the highest bidder to give him/her the option to purchase the vehicle for the reserve amount.

 

Auction company is not required to disclose reserve at any point during the auction process.

 

A bid by any person shall be conclusive proof that the person has made himself acquainted with these conditions of sale and has agreed to be bound by them.

 

All bidders wishing to participate in a secured creditor auction must be pre-approved by auction company prior to being able to place bids. Approval is subject to ability to pay and not having a prior financial interest in items being offered for sale. Any person who bids in bad faith or attempts to bid in bad faith will be removed from auction.

 

Payment: Cash is preferred and the recommended method of payment. Electronic wire transfer or ACH electronic check is also acceptable with waiting period.  

 

It is the responsibility of buyer to pay Sales Tax at the time of title & Registration in their jurisdiction. All non titled items will be taxed at time of invoicing, unless a valid resale number is filed with the cashier at time of check out.

 

No items may be removed until settled for in the manner announced. All items must be removed within 5 days from settlement date, at the purchaser's sole cost and risk. If, for any reason, the purchaser fails to remove from the auction site, and/or store the said item at purchaser's sole risk and expense. In addition, purchaser shall be liable for any rent incurred or damages suffered by auctioneer or secured creditor because of purchaser's failure to timely remove any such item.

 

Though all descriptions and commentary are believed to be correct, neither Auctioneer nor Seller makes any warranties or representations of any kind with respect to the property, and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, period, culture, source, origin, condition, etc.

 

A Buyers Premium will be added to all purchases in accordance with the posted schedule.

 

Neither Auctioneer nor Seller shall be liable for any personal injury on the sale premises. Buyer assumes all risk and liability whatsoever resulting from the use of the item(s) sold here under, and shall defend, indemnify, and save harmless Seller and Auctioneer from any liability.

 

In the event Auctioneer or seller is required to employ an attorney to enforce any term of this agreement, purchaser agrees to pay reasonable attorney's fees.

 

All advertised items are subject to and may be withdrawn from sale prior to auction start.
